  Terms of Service for Roore Pickleball

  1. Acceptance of Terms

  By downloading, installing, or using the Roore Pickleball mobile application ("App," "Service," or "Roore Pickleball"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to  these Terms, do not use the App.

  These Terms constitute a legally binding agreement between you and Roore Pickleball ("Company," "we," "us," or "our"). We reserve the right to modify these Terms at any time, and such modifications will  be effective immediately upon posting.

  2. Eligibility

  You must be at least 13 years old to use Roore Pickleball. By using the App, you represent and warrant that:

  - You are at least 13 years of age

  - You have the legal capacity to enter into this agreement

  - You are not prohibited from using the App under any applicable laws

  - If you are under 18, you have parental or guardian consent

  3. Account Registration and Security

  Account Creation

  To access certain features, you must create an account by providing:

  - Accurate and complete information

  - A unique username and secure password

  - A valid email address

  Account Responsibilities

  You are responsible for:

  - Maintaining the confidentiality of your account credentials

  - All activities that occur under your account

  - Notifying us immediately of any unauthorized use

  - Ensuring your account information remains current and accurate

  Account Termination

  We reserve the right to suspend or terminate accounts that:

  - Violate these Terms

  - Remain inactive for extended periods

  - Engage in fraudulent or illegal activities

  - Harass or harm other users

  4. Acceptable Use Policy

  You AGREE to:

  - Use the App in compliance with all applicable laws

  - Respect other users and their privacy

  - Provide accurate information in your profile and game results

  - Report inappropriate behavior to us

  - Use the App for its intended purpose of organizing pickleball activities

  You AGREE NOT to:

  - Harass, threaten, or intimidate other users

  - Post false, misleading, or fraudulent information

  - Impersonate any person or entity

  - Share inappropriate, offensive, or explicit content

  - Use the App for commercial solicitation without permission

  - Attempt to gain unauthorized access to the App or other accounts

  - Interfere with or disrupt the App's operation

  - Create multiple accounts for deceptive purposes

  - Violate any local, state, national, or international law

  - Collect or store personal data about other users without consent

  - Use automated systems or software to extract data from the App

  5. User Content

  Content Ownership

  You retain ownership of content you post ("User Content"), but grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display,  and perform your User Content in connection with the Service.

  Content Responsibility

  You are solely responsible for your User Content and agree that:

  - You have all necessary rights to post the content

  - Your content does not infringe on any third-party rights

  - Your content complies with these Terms and all applicable laws

  - You will not post content containing viruses or malicious code

  Content Removal

  We reserve the right to remove any User Content that:

  - Violates these Terms

  - Is reported as inappropriate by other users

  - Contains false or misleading information

  - Infringes on intellectual property rights

  - We deem harmful to the community

  6. Privacy and Data Protection

  Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to:

  - Collection and use of information as described in the Privacy Policy

  - Processing of your data for Service functionality

  - Sharing certain information with other users as part of the App's features

  7. Health and Fitness Features

  HealthKit Integration

  If you choose to connect Apple HealthKit:

  - You grant permission to read and write fitness data

  - You understand this data will be used to track pickleball activities

  - You acknowledge that health data accuracy depends on your device

  Medical Disclaimer

  Roore Pickleball is not a medical app and should not be used for medical advice. Always consult healthcare professionals for medical concerns. We are not responsible for any injuries that occur during

  pickleball activities organized through the App.

  8. Location Services

  The App uses location services to:

  - Find nearby pickleball courts

  - Calculate distances to venues

  - Connect you with local players

  You can control location access through your device settings. Some features may not function without location access.

  9. Third-Party Services and Links

  The App may contain links to third-party websites or integrate with third-party services. We are not responsible for:

  - Content on third-party sites

  - Privacy practices of other sites

  - Products or services offered by third parties

  Your use of third-party services is governed by their respective terms and policies.

  10. Intellectual Property

  Our Property

  The App and its original content (excluding User Content), features, and functionality are owned by Roore Pickleball and are protected by international copyright, trademark, patent, trade secret, and

  other intellectual property laws.

  Trademarks

  "Roore Pickleball" and our logos are trademarks of the Company. You may not use our trademarks without prior written permission.

  Feedback

  Any feedback, suggestions, or ideas you provide about the App become our property and may be used without compensation to you.

  11. Game Scheduling and Participation

  Court Bookings

  - The App facilitates game organization but does not guarantee court availability

  - You are responsible for securing proper court reservations

  - You must comply with all venue rules and regulations

  Player Interactions

  - Meeting other players is at your own risk

  - We do not conduct background checks on users

  - We are not responsible for user conduct during in-person meetings

  - Always meet in public places and prioritize your safety

  Game Results

  - Report game results accurately and honestly

  - Disputes should be resolved between players

  - Falsifying results may result in account termination

  12. Disclaimers and Limitations of Liability

  Service Availability

  THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND

  NON-INFRINGEMENT.

  No Warranty

  WE DO NOT WARRANT THAT:

  - The App will be uninterrupted or error-free

  - Defects will be corrected

  - The App is free of viruses or harmful components

  - Results from the App will be accurate or reliable

  Limitation of Liability

  TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROORE PICKLEBALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  - Loss of profits, data, or use

  - Personal injury or property damage

  - Any disputes between users

  - Unauthorized access to your account

  OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, OR $100, WHICHEVER IS LESS.

  Assumption of Risk

  You acknowledge that participating in sports activities involves inherent risks. You assume full responsibility for any injuries or damages arising from pickleball activities organized through the App.

  13. Indemnification

  You agree to defend, indemnify, and hold harmless Roore Pickleball, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising

  from:

  - Your violation of these Terms

  - Your violation of any third-party rights

  - Your User Content

  - Your use of the App

  - Your conduct in connection with the Service

  14. Dispute Resolution

  Governing Law

  These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.

  Arbitration Agreement

  Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You waive your right to a jury trial and class action lawsuits.

  Arbitration Process

  - Arbitration will be conducted by the American Arbitration Association

  - Arbitration will take place in [Your City, State]

  - Each party bears their own costs

  - The arbitrator's decision is final and binding

  Exceptions

  - Email to your registered address

  - Posting on our website

  Continued use after changes constitutes acceptance of modified Terms.

  Termination

  You may terminate your account at any time through the App settings. We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms.

  Effect of Termination

  Upon termination:

  - Your right to use the App ceases immediately

  - We may delete your account and associated data

  - Provisions that should survive termination will remain in effect

  16. General Provisions

  Entire Agreement

  These Terms constitute the entire agreement between you and Roore Pickleball regarding the App.

  Severability

  If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.

  Waiver

  Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

  Assignment

  You may not assign or transfer these Terms without our written consent. We may assign our rights to any successor or acquirer.

  Force Majeure

  We are not liable for any delay or failure to perform due to causes beyond our reasonable control.

  Notice

  Notices to you may be made via email or in-app notifications. Notices to us should be sent to the contact information below.

  17. Special Provisions

  Beta Features

  We may offer beta features that are provided "as is" without warranties. Beta features may be discontinued at any time.

  Premium Features

  If we offer premium features or subscriptions:

  - Payment terms will be clearly disclosed

  - Refund policies will be specified

  - Auto-renewal terms will be explained

  Community Guidelines

  Additional community guidelines may supplement these Terms. Violation of community guidelines may result in account action.

  19. Apple-Specific Terms

  If you access the App through an iOS device:

  - These Terms are between you and Roore Pickleball only, not Apple

  - Apple has no obligation to provide maintenance or support

  - Apple is not responsible for any product liability claims

  - Apple is not responsible for addressing claims of intellectual property infringement

  - Apple is a third-party beneficiary of these Terms with the right to enforce them

  20. Acknowledgment

  BY USING ROORE PICKLEBALL, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
